COUNCIL REGULATION (EU) 2022/576

amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine
‘Article 3ea
1. It shall be prohibited to provide access after 16 April 2022 to ports in the territory of the Union to any vessel registered under the flag of Russia.
2. Paragraph 1 shall apply to vessels that have changed their Russian flag or their registration, to the flag or register of any other State after 24 February 2022.
3. For the purposes of this Article, a vessel means:
(a)
a ship falling within the scope of the relevant international conventions;
(
a yacht, of 15 metres in length or more, which does not carry cargo and carrying no more than 12 passengers; or

recreational craft or personal watercraft as defined in Directive 2013/53/EU of the European Parliament and of the Council (*5).
4. Paragraph 1 shall not apply in the case of a vessel in need of assistance seeking a place of refuge, of an emergency port call for reasons of maritime safety, or for saving life at sea.
5. By way of derogation from paragraph 1, the competent authorities may authorise a vessel to access a port, under such conditions as they deem appropriate, after having determined that the access is necessary for:
(a)
the purchase, import or transport into the Union of natural gas and oil, including refined petroleum products, titanium, aluminium, copper, nickel, palladium and iron ore, as well as certain chemical and iron products as listed in Annex XXIV;
(
the purchase, import or transport of pharmaceutical, medical, agricultural and food products, including wheat and fertilisers whose import, purchase and transport is allowed under this Regulation;

humanitarian purposes;
(d)
transport of nuclear fuel and other goods strictly necessary for the functioning of civil nuclear capabilities; or
(e)
the purchase, import or transport into the Union of coal and other solid fossil fuels, as listed in Annex XXII until 10 August 2022.
6. The Member State concerned shall inform the other Member States and the Commission of any authorisation granted under paragraph 5 within two weeks of the authorisation;

in Article 3h, the following paragraphs are added:
‘4. By way of derogation from paragraph 1, the competent authorities may authorise the transfer or export to Russia of cultural goods which are on loan in the context of formal cultural cooperation with Russia.
5. The Member State concerned shall inform the other Member States and the Commission of any authorisations granted under paragraph 4 within two weeks of the authorisation.’;

Запрещается предоставлять доступ после 16 апреля 2022 года в порты на территории Союза любому судну, зарегистрированному под флагом России.
2. Пункт 1 применяется к судам, изменившим свой российский флаг или свою регистрацию, к флагу или регистру любого другого государства после 24 февраля 2022 года.
3. Для целей настоящей статьи под судном понимается:
а)
судно, подпадающее под действие соответствующих международных конвенций;
(б)
яхта длиной 15 метров и более, не перевозящая груз и перевозящая не более 12 пассажиров; или
(с)
прогулочные или личные водные суда, как определено в Директиве 2013/53/ЕС Европейского парламента и Совета (*5).
4. Пункт 1 не применяется в случае, если судно, нуждающееся в помощи, ищущем убежище, в экстренном заходе в порт по соображениям безопасности на море или для спасения жизни в море.
5. В отступление от параграфа 1 компетентные органы могут разрешить судну заходить в порт на таких условиях, которые они сочтут необходимыми, определив, что этот доступ необходим для:
а)
приобретение, импорт или транспортировка в Союз природного газа и нефти, включая нефтепродукты, титан, алюминий, медь, никель, палладий и железную руду, а также некоторые химические и железные продукты, перечисленные в Приложении XXIV;
(б)
приобретение, импорт или транспортировка фармацевтической, медицинской, сельскохозяйственной и пищевой продукции, включая пшеницу и удобрения, импорт, покупка и транспортировка которых разрешены настоящим Регламентом;
(с)
гуманитарные цели;
(d)
перевозка ядерного топлива и других товаров, строго необходимых для функционирования гражданского ядерного потенциала; или
(е)
приобретение, импорт или транспортировка в Союз угля и других твердых ископаемых видов топлива, перечисленных в Приложении XXII, до 10 августа 2022 года.
6. Заинтересованное государство-член ЕС информирует другие государства-члены ЕС и Европейскую Комиссию о любом разрешении, выданном в соответствии с параграфом 5, в течение двух недель с момента получения разрешения;

в статью 3h добавляются следующие пункты:
4. В отступление от параграфа 1 компетентные органы могут разрешить передачу или вывоз в Россию культурных ценностей, находящихся в аренде в контексте официального культурного сотрудничества с Россией.
5. Заинтересованное Государство-член ЕС информирует другие Государства-члены ЕС и Европейскую Комиссию о любых разрешениях, выданных в соответствии с параграфом 4, в течение двух недель с момента получения разрешения.
